INFORMATION ON THE PROCESSING OF PERSONAL DATA BY SOLIDELE Sp. z o.o.
This information has been prepared in connection with the provisions of the Regulation of the European Parliament and of the Council of the EU of April 27, 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC, hereinafter referred to as the "RODO Regulation", which applies from May 25, 2018. These regulations are designed to enhance the protection of your personal data.
1 Data of the entity that processes your personal data.
The administrator of your personal data is Solidele Sp. z o.o. with its registered office in Rzeszow, Szymanowskiego Street 8, 35-328 Rzeszow, hereinafter referred to as "SOLIDELE POLSKA".

2 Purpose and legal basis for processing your personal data.
Your personal data is processed by SOLIDELE POLSKA for the following purposes:
- Collection of personal data as part of your use of the website www.solidele.audio. In this case, your personal data is processed exclusively for marketing purposes and the execution of the concluded sales contract. SOLIDELE POLSKA does not share data collected as part of your use of the websites with other entities, with the exception of entities providing marketing services on behalf of SOLIDELE POLSKA, which applies in particular to mailing services (e.g. sending commercial information). The processing of personal data for this purpose is dictated by Article 6(1)(a) of the RODO Regulation, which means that it requires your consent.
- Conclusion and performance by SOLIDELE POLSKA of a contract for the sale of electronic audio equipment through the website www.solidele.audio, which includes the shipment of equipment to the recipient and the performance by SOLIDELE POLSKA of its obligations under the sales warranty or quality guarantee, in addition to the performance of other after-sales services. The processing of personal data for this purpose is dictated by Article 6(1)(b) of the RODO Regulation and does not require your consent, as this is processing necessary for the performance of a contract to which the data subject is a party, or to take action at the request of the data subject prior to entering into a contract. In the case of repairs carried out under a warranty provided by the manufacturer /distributor, SOLIDELE POLSKA may have access to your data in order to verify warranty rights. Then the basis for data processing is the entrustment agreement concluded with the manufacturer / distributor based on Article 28 of the RODO Regulation. This does not apply if a document confirming warranty entitlement is presented when the equipment is handed over for repair.
- Accepting orders and making repairs to electronic audio equipment purchased from other vendors. Repair orders may be placed directly with SOLIDELE POLSKA - in which case the processing of data is justified by the content of 6(1)(b) of the RODO Regulation and does not require your consent, as it is processing necessary for the performance of a contract to which the data subject is a party, or to take action at the request of the data subject prior to entering into a contract. If you report a defect to a vendor other than SOLIDELE POLSKA, the equipment is further transferred to SOLIDELE POLSKA along with your personal data. Depending on the cooperation model, SOLIDELE POLSKA processes these personal data either as an independent data controller or as a processor, based on an entrustment agreement concluded on the basis of Article 28 of the RODO Regulation. In the case of repairs carried out under a warranty provided by the manufacturer/distributor, SOLIDELE POLSKA may have access to your data for the purpose of verifying warranty entitlements. Then the basis for data processing is the entrustment agreement concluded with the manufacturer / distributor based on Article 28 of the RODO Regulation. This does not apply if a document confirming warranty entitlement is presented when the equipment is handed over for repair.
- Extension of the warranty beyond the standard period for the selected electronic equipment, under the terms and conditions of SOLIDELE POLSKA or the regulations of another guarantor. The processing of personal data for this purpose is dictated by Article 6(1)(b) of the RODO Regulation and does not require your consent, as it is processing necessary for the performance of a contract to which the data subject is a party, or to take action at the request of the data subject prior to entering into a contract. The renewal of the warranty may involve your consent to the processing of personal data in the form of your e-mail address for direct marketing purposes, including the sending of commercial information by e-mail. In this case, the processing of personal data is dictated by Article 6(1)(a) of the RODO Regulation, which means that it requires your consent. The withdrawal of this consent does not result in the loss of your rights under the extended warranty.
- Processing in connection with SOLIDELE POLSKA's legal obligations to issue and store invoices. The legal basis for the processing in this case is Article 6(1)(c) of the RODO Regulation - the processing is necessary for the fulfillment of a legal obligation incumbent on the controller, thus it does not require your consent.
- The processing of data for the purpose of establishing, defending and asserting claims, which arises in particular from your rights under warranty and guarantee, in connection with the sale or repair of electronic equipment by SOLIDELE POLSKA. It is also justified by SOLIDELE POLSKA's claims for payment for the performance of the contract of sale or repair of equipment for a fee. This processing is based on Article 6(1)(f) of the RODO Regulation - it is necessary for the purposes of the legitimate interests pursued by the administrator.
3 Information on automatic processing of personal data, including profiling.
Your personal data will be processed by SOLIDELE POLSKA in an automated manner, which includes profiling. However, this does not have any legal effect on you or otherwise significantly affect you. Profiling allows us to better assess your shopping preferences and to tailor advertising messages and commercial offers to your individual interests.
4 Information on categories of recipients of your personal data.
We provide your data only to those entities that provide us with services remaining in connection with the sale or repair of electronic equipment conducted by SOLIDELE POLSKA, namely:
- entities providing warehouse services on our behalf and organizing forwarding of goods,
- entities intermediating on our behalf in the sale of equipment,
- entities providing postal or transportation services,
- entities providing consulting, legal, accounting, auditing, debt collection and IT services to us,
- entities supporting our marketing activities, in particular organizing the mailing of our newsletters and commercial information.
5 Obligation to provide personal data.
It is necessary for you to provide personal data if you purchase equipment from www.solidele.audio, which includes: name and surname, residential address, delivery address, telephone number, e-mail address.
In order to repair the equipment, including its return shipment after repair, it is necessary to obtain the following data from you: name, residence address, delivery address, telephone number, e-mail address, name and model of the equipment submitted for repair or for possible replacement with defect-free equipment. In the case of a paid repair, we additionally require your data necessary for issuing an invoice - if such a request has been made.
f you wish to extend the quality warranty on the equipment beyond the standard period, you are required to provide the following personal data: name, home address, telephone number, e-mail address, name and model of the purchased equipment, date of purchase, place of purchase, name of the seller. Your acceptance of the content of the terms and conditions of the warranty extension may involve your consent to the processing of your personal data in the form of your e-mail address for direct marketing purposes, including the sending of commercial information.
In other cases, the processing of your personal data may be carried out only on the basis of a previously given voluntary consent, to the extent and for the purpose expressed therein.
6 Transfer of personal data outside the European Economic Area.
In general, SOLIDELE POLSKA does not transfer your personal data outside the European Economic Area. Such a situation may occur only exceptionally, in the event that you indicate a shipping address for equipment after its purchase or repair located outside the European Economic Area.
7 The right to withdraw consent to the processing of personal data.
If the processing of personal data is based on your consent (Article 6(1)(a) of the RODO Regulation), you have the right to revoke that consent at any time. This revocation does not affect the compliance of the processing carried out on the basis of consent before its revocation with the applicable law.
If you revoke your consent to the processing of personal data for marketing purposes in connection with the extension of the equipment warranty beyond the standard period, you will not lose your right to benefit from the extended warranty period.
8 Right to object.
You have the right to object at any time - on grounds relating to your particular situation - to the processing of your personal data for the purposes of the legitimate interests pursued by SOLIDELE POLSKA, including objection to profiling. In that case, SOLIDELE POLSKA will no longer be entitled to process such personal data unless we demonstrate the existence of valid legitimate grounds for processing that override your interests, rights and freedoms or grounds for establishing, asserting or defending claims.
If we process your personal data for direct marketing purposes, you have the right to object at any time to the processing of your data for such marketing, including profiling, to the extent that the processing is related to such direct marketing. Your data will then no longer be processed by SOLIDELE POLSKA for direct marketing purposes.

9 Your other rights.
You also have the following rights in connection with the processing of your personal data:
- The right to access your personal data, including the right to obtain a copy of such data,
- The right to request rectification and completion of your personal data - in case your data is incorrect or incomplete,
- The right to request erasure of personal data (the so-called "right to be forgotten"), in case one of the following circumstances occurs:
- the data are no longer necessary for the purposes for which they were collected or otherwise processed,
- you have withdrawn your consent to the processing of personal data, which is the basis for the processing of the data, and there is no other legal basis for the processing of the data,
- you have lodged an objection to the processing of personal data,
- your personal data is processed unlawfully,
- your personal data must be deleted in order to comply with a legal obligation.
10 Right to request restriction of personal data processing - in case:
- you question the accuracy of your personal data,
- the processing of the data is unlawful, but you object to the deletion of the data, requesting instead that the data be restricted,
- SOLIDELE POLSKA no longer needs the data for its purposes, but you need the data to establish, defend or assert claims,
- you have raised an objection to the processing of the data, until it is determined whether the legitimate grounds on the part of SOLIDELE POLSKA override the grounds for the objection.
11 Right to data portability - in case the following conditions are met together:
- data processing is carried out on the basis of a contract concluded with you or on the basis of your consent,
- processing is carried out by automated means.
12 Period of storage of personal data.
Your personal data is stored by SOLIDELE POLSKA until all obligations of the parties under the concluded contract for the sale of goods have been fulfilled, or an order for the repair of electronic equipment has been carried out, or it has been replaced with non-defective equipment.
Further storage of your data takes place:
- for the purposes of tax and accounting regulations, for the period resulting from these regulations,
- for the purposes of asserting potential claims or defending against potential claims related to the activities of SOLIDELE POLSKA, until they are satisfied or have become time-barred.
In the case of personal data obtained for marketing purposes, they are kept until you object to their processing.
13 Right to lodge a complaint.
If you consider that the processing of your personal data by SOLIDELE POLSKA violates the provisions of the applicable law, you have the right to lodge a complaint to the President of the Office for Personal Data Protection, ul. Stawki 2, 00-193 Warsaw.
